Sorry guys, Heather is within her rights this time. Jana admitted to killing Carmen and went to prison. Michael got her released because of the "tumah" and the charges were dropped, therefore charges can be brought again. Murder has no statute of limitations. You can read all about double jeopardy in wikipedia, that's where I found this.

Someone may not put Heather in her place but she will get hers because once she finds out all the things that Adam has done, that will be as good as someone puting her in her place. This will be her karma. She loves Adam and she will be hurt again when she finds out everything he has done. She will be very unhappy and her whole world will fall apart. That will wipe her smug grin right off her face at everybody she wants to put away the minute they do something wrong.

I've been hoping that she could get a case that she could actually win, once in awhile. WE all know that the characters on trial have committed the crimes, but somehow, they always worm their ways out. Then some fans cry foul and call the DA or ADA bad names because they are trying to do what they were hired to do, and do it with the evidence that was gathered. We have all watched Gloria, and Mikey, and Kevin, and Jana, and TGVN,and Amber, and even Paul, (for example) do many illegal things and we know that, because they are principals, they will more than likely get away with it. This is just Daytime Drama and we love it or we wouldn't be watching! ps. Remember when Christine Blair ALWAYS won her cases?

I have to agree with you. This is my main issue with her right now is that when it comes to her "doing her job" ,if that's what they call it, she is too quick to drop the gun with people's cases. And the dumbest thing about this is, is that when it comes to people that need to be tried and put away she is never this good with their cases and quick to put somebody in jail but it always seem to be a person or people that we root for..lol!!!

My question is if Jana was really sick then what does that has to do with now. I mean Heather dropped all the charges and now what? She can press charges for can Lauren do the same thing with Sharon or Sharon do the same thing with Phyllis.
I mean she is so quick to judge other people but can't she what is really in front of her face.

There is no double jeopardy in this case. You can only have double jeopardy if the case went to trial and the defendant was found not guilty, and therefore, cannot be retried on the same charge or charges.

This case NEVER ever went to trial, even though Heather was he!! bent on prosecuting Jana. Because of Jana's medical condition and her operation to have the tumor removed, Michael, in his desperation, was able to bring a box of medical data to Heather's office, and after her review of the medical data, was he finally able to convince Heather to dismiss the charges.

When Heather had the charges dropped against Jana, she had the dismissal of these charges made WITHOUT prejudice, meaning that the prosecutor can typically refile the charges, or reopen the case, should further information come to light that sheds a different light on the case.

The defense, however, would seek to have the charges dismissed or dropped WITH prejudice, meaning that the prosecution cannot re-open the case or refile the charges.
