Clarice delivers bad news to Kate, Lucky updates Lulu about Johnny's case and Spinelli loves his new roomie.

After Alexis has left Jax's house, she meets Jerry at The Metro Court. She tells him about her misgivings about his brother's marriage and asks him for a favor.

"Kate, there's something you need to know about," Clarice says the second Sonny and Kate walk through Sonny's door. Kate practically purrs when she asks if it has anything to do with Crimson. When Clarice says that it doesn't, Kate promises to focus on her when she comes into work. Max and Diane remain in the room and Diane is itching for Max to have a private conversation with Kate. She manages to get Kate to meet Max on the terrace for an iced-tea so that she can go over legal matters with Sonny. It doesn't take Sonny long to realize that Diane doesn't really have anything to talk about.

Out on the terrace, Kate wants to daydream about her island vacation but Max keeps trying to discus the real world. He asks Kate if she's worried at all about Mrs. C. and Kate reminds him that Carly is now Mrs. J. Then she tells him to take this matter up with Sonny. Max tells her that it's all good and she hugs him as Diane and Sonny come out to join them. Diane is seething when she can see that Max didn't tell her about Carly. Kate excuses herself to go to Crimson and after she's gone, Sonny tells Max and Diane that he is accepting resignations from anyone who doesn't like the idea of him and Kate getting married.

Jax goes into Crimson looking for Kate, but Clarice says she isn't there yet. He takes the opportunity to say that it's hard to trust her now that she helped set up his wife. Clarice apologizes and adds that Carly isn't as innocent as he thinks.

In the courtroom, Scott offers to supply documentation that Logan Hayes was an undercover police officer at the time of his death. Ric objects, but the judge only offers a brief recess. The jury grumbles amongst themselves that someone's life is now in their hands. Over at the prosecution table, Anthony tells Trevor that every juror will pay if they sentence his son to death. Meanwhile, Ric tells Johnny that he can plea bargain and get maybe only ten years instead of lethal injection. Johnny won't do it. He says that Anthony will settle for nothing less than an acquittal and that Ric will be in the line of fire if he doesn't get it.

As the proceedings get underway, Scott paints Logan as an American citizen who wanted to serve his country. Ric points out that Logan was so brutal that one of the two men were going to die that night and Johnny was merely defending himself. They get into various knives, motives, witnesses and the jury takes it all in. Ric is able to get Detective Harper to admit they don't have an eye witness, and Trevor is impressed with his son's work. Then, Claudia is called to the stand by Scott.

Jason brings Spinelli home from the hospital. Once they are seated on the couch, Jason asks why he would take such a risk with his life? Spinelli says that he's a hopeless wimp and wants to be more like Stone Cold. Jason asks Spinelli exactly what part of his life does he want? He lists his least desirable traits and tells Spinelli that he is already a better person than he is. Spinelli says that he is sorely deficient in all facets of manly prowess. Jason quietly points out that he lost Michael and Sonny this year, and then says that Spinelli is practically all he has left. Later, Jason serves up some tomato soup and crackers, but the Jackal says that he normally exists on snack food. Before Jason can explain, Maxie shows up with her luggage.

Nikolas finds Lulu outside at Shadybrook and takes that as a good sign. He asks what has her feeling so good and she attributes it to spending time with their mom and holding her hand. As they talk, Lucky joins them and Lulu asks how Johnny's trial is going. Lucky hesitates, but then carefully tells them about the "murder with special circumstances" case against Johnny which could end in death penalty. Lulu wants to testify, but her brothers assure her that Johnny's family will protect him.

After she's sure that her sons are gone, Laura finds Lulu and asks her to keep their secret a little while longer. Lulu agrees, but Laura can see that something is on her mind. Laura asks her not to shelter her from bad news, so Lulu says that Johnny is facing the death penalty instead of her.

Jax has gone home and finds Jerry waiting for him instead of Carly. Jerry says that Alexis shares her worries with him about Carly and then says it's unnerving to have his lady friend so obsessed with his brother. Jax doesn't want to discuss his marriage, but Jerry surprises him by saying that Carly is the best thing that ever happened to him.

Sonny finds Carly at The Metro Court and she tells him that Kate is probably upstairs in her office. Sonny says that he and Kate just returned from the island and it brought up a lot of old "stuff". He mentions the seashell collection and Carly smiles at the memory of Michael collecting them all. Sonny brings her back into the present and Carly ends up wishing him the best in his new life. He asks why the change of heart and Carly says that she almost had to lose Jax to realize how perfect he is for her.

At Crimson, Kate wraps up a phone call and promises Clarice that she's all ears. Clarice stumbles for words and finally says that she doesn't want to see her hurt but she should know this. Then she tells her what she heard Max and Diane talking about. "Back in May, Sonny and Carly had sex."
