Max, Milo, Bernie and Diane are packing up Sonny's office when Jason comes in and asks for a moment alone. After a minute to look around he quickly pulls everyone back into his office to get to work. He tells them that he'll try to keep the violence to the minimum, but he won't be a prisoner to this business. He asks if anyone wants to resign and if so, they should do so now. No one speaks, so Jason proceeds to give orders about how to proceed so that they aren't vulnerable now. Diane takes the opportunity to ask if he has a problem with her relationship with Max. Jason said he doesn't care as long as everyone focuses on their jobs.

Carly stomps into the coffee shop on her way to Jason's office and Diane stops her to express her sympathies over Michael. Carly thanks her and asks how she fared in the business dealings. Diane says that she will work for both Jason and Sonny from this point on. Carly turns and walks into Jason's office. "You and I can't see each other any more," he says. He says that none of the sacrifice means anything if she remains a target. Carly tells him that maybe he should stay away from Morgan, but the two of them need each other. She says he walked away from his own son and she won't let him be alone in the world.

Diane is in Jason's office working on the transition from a legal standpoint. She suggests that Jason could be a sitting duck for an IRS audit now and adds that it's time to update his will. Before she can spread more good news, Max comes in and announces that one of their cargo ships was hit! They all rush out to the waterfront and stand in the glow of the fire on the water. Max quickly tells Jason that he has an idea on how to retaliate but Jason cuts him off. "Anthony Zacchara did this to me and I'm the one who is going to respond."

Diane and the notary promptly show up in Sonny's office and matter-of-factly lay out the terms of the transfer of power. Sonny will retain sole ownership of his home and island and Jason will buy the rest. Both men sign the papers and then Jason pulls out the custody papers for Diane to see. Diane can hardly believe her eyes and reminds Sonny to think about what he's doing. He quickly signs them and says that he will be the one to show them to Carly.

Diane comes to Sonny's office and learns that Jason doesn't want to take over the business. He orders her to make up the papers anyway. As she walks through the coffee shop on her way out, she invites Max over for dinner and Milo begs her not to mess up his brother's life. Diane and Max both assure Milo that neither of their careers will suffer because of their relationship. After she leaves, Max holds Milo's head in a death grip as only a big brother can do.

Max and Milo are arguing at the coffee shop when Diane walks in. She asks what's going on and Milo blurts out that Max is still in love with Mrs. C. Max clears it up for Diane and says that she is the only woman the he "presently" cares about. She asks if he'd like some water "…to go with that foot!" and then tells him that in spite of his inability to be a smooth talker, she reciprocates completely. They both smile like grade-schoolers.

Diane is summoned to Sonny's office. He wants her to draw up papers of their own but Diane insists that it's very ill advised and once they are filed they are irrevocable. She wants him to take his time and consider all his options, but Sonny won't hear of it. He says that he's got to do what he thinks is right for his family, but Diane asks if he's considered what this decision would do to his life. He insists on going forward so Diane coolly tells him that she'll have a draft ready tomorrow.

On her way out she stops to talk with Max in the coffee shop. He tells her that Sonny's in a foul mood and hopes he wasn't too hard on her. He asks her to get away for the weekend and she is intrigued. He says his buddy has a cabin with a great outdoor sink for cleaning fish. Although it's not the French Riviera, Diane regroups ever so briefly and asks when they can leave. A little later, Johnny shows up in Sonny's office and demands to know where Claudia is. Sonny calmly asks if he's come to try to kill him again. As Johnny starts to threaten what will happen if he hurt his sister, Claudia calls him to say that she's okay and that he's not to worry.

Diane pops into Crimson headquarters and gushes over the new dress samples that have arrived. Lulu tells her she can have what she wants because she isn't into this stuff. Max arrives in hopes that Kate will do him a favor. He waits with Diane and when Kate arrives, Max asks her to intervene and make sure that the boss knows that he and Miss Miller belong together. Kate listens as Diane jumps in and says that she is perfectly able to keep her professional head about her no matter what man she is seeing.

Diane goes out to Sonny's place and Max tells her that Sonny is gone, but she could help him "check" the house from the guest room on down. As they proceed to make out, he keeps pulling back and asking if they should really do this? Diane wants to continue, but given that Sonny is visiting Michael, hot sex isn't exactly appropriate at the moment. They sit on the sofa and sadly recall that it was Michael who brought them together and now he's gone.
