Obama's choice to replace Souter appears to be Sonia Sotomayor. According to the New York Times:

This month a video surfaced of Judge Sotomayor asserting in 2005 that a “court of appeals is where policy is made.” She then immediately adds: “And I know — I know this is on tape, and I should never say that because we don’t make law. I know. O.K. I know. I’m not promoting it. I’m not advocating it. I’m — you know.”

So she knows appeals courts don't make law, but she still feels courts of appeal are where policy is made...hmmmm, that is interesting. I sure hope her written opinions are this clear! Boy Scalia & Thomas are going to take this woman to town, intellectually speaking.

Over the past few weeks, I've been talking to a range of people who have worked with her, nearly all of them former law clerks for other judges on the Second Circuit or former federal prosecutors in New York. Most are Democrats and all of them want President Obama to appoint a judicial star of the highest intellectual caliber who has the potential to change the direction of the court. Nearly all of them acknowledged that Sotomayor is a presumptive front-runner, but nearly none of them raved about her. They expressed questions about her temperament, her judicial craftsmanship, and most of all, her ability to provide an intellectual counterweight to the conservative justices, as well as a clear liberal alternative.
The most consistent concern was that Sotomayor, although an able lawyer, was "not that smart and kind of a bully on the bench," as one former Second Circuit clerk for another judge put it. "She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren't penetrating and don't get to the heart of the issue."

So they want a liberal, obviously, but they would prefer an intelligent one who can go toe to toe with Scalia, Thomas, etc. & though she's clearly liberal, as Rosen states:
"Her opinions, although competent, are viewed by former prosecutors as not especially clean or tight, and sometimes miss the forest for the trees."

Speaking at Duke in 2005, Sotomayor declared: "(The) court of appeals is where policy is made. I know this is on tape, and I should never say that because we don't make law I know." She and the audience joined in the laughter.

Who were they laughing at? Americans who still believe the role of judges is to apply the Constitution as the Framers intended and to interpret the law as written by our elected legislators.

In Barack Obama's America, that is so yesterday.

President Obama has chosen Judge Sonia Sotomayor to replace Justice David Souter. Good riddance to Souter and thanks for nineteen years of nothing. As for Sonia, she’s the Left’s dream nominee: a proud judicial activist out to amend perceived societal wrongs and extract justice as she feels fit -- let The Constitution be damned. “The Court of Appeals,” she said, “is where policy is made” and that is exactly what she’s done for the last decade.

Imagine if Justice Roberts had delivered a speech entitled “A Male Anglo-Saxon Judge’s Voice” in which he said: “I would hope that a wise white man with the richness of his experience would more often than not reach a better conclusion than a Latino (or Black) woman who hasn’t lived that life.” The Left would have screamed “Racist!” from the roof tops until Roberts’ name was pulled from consideration.



It's nice how the prerequisite to being a 'racist' or a 'bigot' is to be a white male...if you're not a white male, you apparently are born with a free pass to say whatever racist, asinine remarks you want (*think Jeremiah Wright*) & - oh wait - that's right, you've also won a seat on the U.S. Supreme Court!

So FOXNEWS still has the most viewer,good for them ! since I only watch Fox for most news beside CNBC business Channel for stocks
