If you are talking about your own will..it's very smart to have a lawyer draw up the document...saves alot of heartache and pain for the family members..and also prevents family in-fighting. No one could question what they think they deserve..it will be stated in a legal document so it will be clear to all parties involved. |

If you're talking about an accident settlement then I think it is wise to hire your own lawyer to tend your interest. |

This will be a nursing home lawsuit on behalf of my mom (who passed away at the end of last year), my father is the administrator, and the thing is he intends to renege on certain things, like earlier this yr when he got life insurance payments, he told me and my sister (we're both over the age of 35) that he would give us a certain amount but when the checks came, he didn't give it to us, and now with this lawsuit which may be over millions of dollars, he told me and my sister the amount he "said" he would give us, and me and my sister were just thinking that maybe we should just have the attorney draw of up documents to equally distribute the funds... |

I call my baby jazzy too...lol, she's 8 1/2 months now...and yes, we're shipping the car and putting some of the boxes in the trunk of it and whatever doesn't fit, we'll ship via UPS |

awwww, cute names for them...we're sorting through boxes every weekend, see, husband and I moved into my father's house earlier this year, and most of our things are still in boxes and we're just sorting through those..so far, we have about seven boxes and we're putting our clothes, of course, in the suitcases.. |

Did your mother put you and your sister as beneficiary's on her life insurance policy? Alot of people put their surviving spouse first, then if there is no longer a spouse then they list the children. She had to have listed you as a beneficiary in order to receive any of that money. And I believe that the money goes directly to the person/persons listed as beneficiary's directly from the insurance company. But I could be wrong on that..check into it. As far as the lawsuit that may also go directly to your father because he is the surviving spouse. Unless you all filed the suit equally. When My dad passed all his life insurance went to my mother, if she was not living at the time then there were provisions in his policy to have the money divided between his children. When my mother passed her life insurance, sale of the house and anything else was divided equally amongst the children. That was in their wills. And so sorry for your loss..I hope the memories you have will comfort you. |

Thanks rei, my father got the insurance money earlier this year, he is name the administrator on the lawsuit, and the attorney said on certain cases, they automatically draw up orders for the judge to sign to have the settlement divided equally amongst the beneficiaries... we all (my sister, father and myself) to talk to the attorney about the lawsuit |
