Further....I don't see how a layperson (you, me, etc) can say that the SC got it wrong. These are minds incredibly well versed in the law and constitution. While we may have our opinions, I know I haven't been to law school, and I certainly have never been inside the court on a major case to listen to the arguments presented and how they are presented, so I would not really be able to walk up to any of them and tell them they got it wrong and be able to back myself up. I may disagree (that is our right) but I have to defer to their intellect wether I like them or not. Well in the case of their 'separate but equal' ruling, the court later reversed themselves in Brown v. Board of Education. I agree their religious beliefs should not affect their interpretation of the law. Is it a coincidence that the four most conservative justices are Catholic? I don't know. Kennedy, who is usually the deciding vote in any 5-4 decision, is also Catholic. Aside from their religious beliefs, these 5 are typically strict constructionists, so they won't be eager to hear a case on gay marriage b/c marriage laws are not an issue the feds are eager to delve into & all they have to say is 'Sorry, this is not a Constitutional issue & we don't believe state laws forbidding gays from marrying are unconstitutional.' Sotomayor is a wildcard at this point on many issues. She may feel gays should be granted the legal right to marry (I have no idea if she does), but she may also believe it is not the place of the Supreme Court to enact such a law. And honestly I don't know where the remaining 3 fall on this issue either (Stevens, Ginsburg, Breyer). Stevens is old & Ginsburg has had health issues so they will likely go while Obama can name their replacement. I doubt they ever rule on this matter...& their replacements will be selected by Obama, who himself is not a gay marriage supporter. I think the fact that many states have already voted on the marriage issue will remain a deterrent to them ever agreeing to hear a case. The CA S.C., despite an earlier 4-3 ruling that gays could marry, were unwilling to overturn the people's vote. Anyway, my main point was that were they to agree to hear a case now, I don't think the ruling would favor gay marriage. I don't think they would force states to change their marriage laws either way (forcing all states to allow gays to marry or forcing all states to enact one man/one woman laws). Basically they would punt, send the issue back to the states where it is now. |

They are promised a better life for their families & brought into this country by unscrupulous people & then put into servitude. By the way, when you bring up & speak of the Bible you ARE bringing up religion!! My point was God did not want slaves People did. Slavery isn't a bible thing and it has nothing to do with it It has to do with greedy people! My family goes back to the time of the mayflower they came over as indentured servents so I get what your saying. And some were even here before that( Native Americans) My point was that it didn't have anything to truly do with God!! Tell it how it is girl! For the people who don't agree with this obviously don't know how it is to be a minority in America. Or know many minorities and know what they struggle with. I can tell you this is the truth people can cover their eyes all they want but I had to work much harder to be recognized then my white co workers when I worked in the corporate world! Maybe it's where you live. I work with with a wide array of people and the only thing that matters for your pay is how long you've been there! And thats it!! Well your company might not practice racism but do you know how much your black co workers make? Are you serious?? We are in a time where we have a BLACK president of our country!!! I know many black people who are way more successful than myself!! It has nothing to do with race hon, it's all about Education...go talk to Bill Cosby

Doesn't affect me in the least, but I really want some interpretations on my argument that marriage is not a right since heteros have to apply for the license. They are denied just like would-be polygamists, incestuous relationships, etc. If it was a right, there wouldn't be a need for the license, right? |
