In the hallway, Aidan tells Zach about his visit with Ryan at conFusion. As they talk, Kendall walks up and asks what Aidan did to Ryan. Aidan tells her and Kendall thanks him. All three return as Erica is hauled off to jail. She tells everyone that she will be fine. Jack is very broken up as he watches her leave the courtroom. Greenlee apologizes to him but then ruins the father/daughter moment by telling him he should start dating again. Jack walks out of the room. Kendall takes Zach aside and says she lied to him. She tells him about meeting with Ryan at the bar in LA and says she is sorry she didn't tell Zach sooner. When she assures him that she only wanted to help Ryan but now realizes she can't, Zach forgives her.
Zach and Kendall arrive at the courthouse just as the judge says he isn't bound by the sentencing recommendations or Erica's deal! Both Jackson and Samuel object but he won't give in. They agree to meet in chambers; on his way there Jack tells Erica not to give up. Josh, Kendall and Zach hover over her but Erica wants space. She asks Zach to look into the judge, believing he may be in on something with Samuel! Zach tells Erica to calm down and to distract her brings up Ryan's LA visit. Just then Greenlee walks in, aggravating Erica. She is very sympathetic but that only worries Erica more. Greenlee and Zach go into the hall. Erica focuses on Kendall, saying that she needs to keep her distance from Aidan and Ryan and any other man so that she doesn't ruin things with Zach. Kendall angrily tells Erica that she can handle her own life.
In the hall, Zach says he knows about Kendall's secret meeting with Ryan. Greenlee says she knows about it, too. Zach wonders why Kendall wouldn't tell him and Greens suggests that Kendall just didn't want to worry him. They follow Jack and Sam into the courtroom. Erica goes straight for Samuel's throat, telling him he won't get away with this. Jack interrupts, saying Sam fought for her. Erica is surprised. Samuel and Jack tell her they don't know what the judge is going to do and Jack tells her that she has to be contrite and apologetic when the judge returns. "Because you are your own worst enemy," he says. The judge returns. Erica stands and solemnly pleads guilty. She apologizes to the judge and implores him to believe that she wasn't trying to pull one over on anyone or hurt anyone and that she deserves her punishment. The judge orders her sentence: a $5 million find, 2 years of community service and 6 months in a federal prison. Erica is relieved. The judge gives her 3 weeks to prepare for her stay; Erica says she is ready to go now.
Jack finds Samuel at the Valley Inn and tells him to stop persecuting Erica. Samuel compares his prosecution of Erica to Dr. Martin Luther King's "Do The Right Thing" speech. Jack says sending Erica to jail isn't the right thing and suggests if she were poor Sam wouldn't prosecute her. He goes upstairs to pick up Erica at her hotel room. Erica dons a disguise - a short, black wig and oversized sunglasses - and they proceed to the courthouse. Amid the cacophony of reporters wanting answers, Samuel approaches and tells Erica she shouldn't go inside just yet. Sam tells Erica about Jack meeting him at the Valley Inn. Josh tries to call Erica inside but a woman starts yelling from inside the courtroom and Sam says they need to stay out. Erica goes inside anyway. Carmen Morales is the defendant. She swears that she is an innocent victim and that she didn't do anything wrong. She tries to run from the courtroom after the sentencing but runs straight into Erica! Carmen asks Erica to sign her arm but the bailiffs haul her out of the courtroom first. Erica is called to the stand for her sentencing. Sam tells the judge their deal. The judge says the charges are too serious for such a light sentence!
Erica is getting ready for her last night at home when Jack walks in the door. She shows him her bags, wondering if she has over-packed! She says she is kidding and the clothes are going to charity. When Jack goes off on a tangent against Samuel, Erica asks him not to talk Samuel, business - or prison - for the rest of the night. Over coffee they revisit the best parts of their relationship, including Erica's many French maid outfits! "Out of all my seven husbands, I've had the best times with you," she says sweetly, telling Jack how much she loves him. They kiss. He holds her as she worries about the sentencing the next day. With a final kiss, Jack grabs his jacket and leaves. Erica is still worried, though.
Erica finishes her press conference. Opal has arrived and says how proud she is. A few reporters stay behind to ask questions but Erica won't answer any of them. Pam asks Erica if she is certain she did the right thing and Erica says yes. Jack says this may have been a colossal mistake. He is even more annoyed when he realizes Opal convinced Erica to come forward with her plea. Jack angrily quits as her defense attorney! Sam approaches Erica and surprises her by saying he isn't angry at her maneuver. They exchange a few barbs, with Erica stating she still doesn't think she did anything wrong. Then, she threatens to find whatever secrets Samuel has - and tell the world about them! He walks away. Sam runs into Jack, who tells him that just because he doesn't work for Erica doesn't mean he isn't watching her back. Jack walks off. Sam turns and watches the reporters fawn over Erica.
Erica has called a meeting with her staff and Jackson and explains that she is going to fight Sam. She has convinced the network brass to keep the show on the air in re-runs and swears that they will be back on top before no time. Pam notes that the fans are supporting Erica and another assistant suggests that Erica play up her charitable work. She doesn't want to do that. Jack dismisses everyone else. Erica asks him if she has a chance to win this fight. Rather than answering Jack asks why she is taking Sam's attacks personally. Opal arrives; Jack asks her to dinner and then leaves. He kisses Opal on the way out. Opal comments that there is still heat between them but Erica changes the subject. She admits she is very worried about Sam. Opal advises Erica to surprise Sam and fight. Erica calls Val to set up a press conference for the afternoon. At the press conference, Erica says she had no idea she was committing a crime and then offers to go to jail just as Sam walks in the door!
Erica is cleaning up her nearly cleaned out New Beginnings office with Pam and Val when Jack walks in. She insists that she can keep the network from canceling her show but Jack says she can't stop it. He shows her the morals clause in her contract. Erica tells Pam and Val to re-file her papers and replace her makeup on her makeup table. Erica insists that buying her shares of Chandler was only a good business decision and that Adam didn't tell her when or how much to buy. Sam walks in and tells Erica that she will be convicted because she knew that Adam was taking back his company before she bought the stock. Erica doesn't see that as a bad thing. Then, she whispers that Sam is guilty of exactly the same thing! She tries to compare what Sam is doing to her to the way she purchased the Chandler stock. Before she can really get going, Jack butts in and tells Sam they want to make a deal: a suspended sentence and a million-dollar fine! Both Sam and Erica turn down the offer. Sam has his own offer: a $5 million fine and a 6-month jail sentence! He gives them one day to decide and leaves. Jack tells Erica they should seriously consider the deal because Samuel has the goods on her. Erica insists she'll put Sam away!
Meanwhile in the main squad room Jack angrily suggests that Sam is just trying to win more votes for the upcoming election. Sam walks off. Jack goes into the holding area and tells Erica he is going to get her out of jail. They report to the court room where Samuel is waiting. Sam and Jack present their cases as the judge listens. The judge is about to set bail when Erica stands and swears she hasn't done anything wrong and then says Samuel is using her to further his political ambitions. Jack tries to get her to be quiet but she just keeps talking. The judge tells Erica to settle down or she'll be charged with contempt of court. Samuel asks for a high bail; Erica makes a smart remark and Jack has to quiet her down again. The judge sets bail at $1 million! Erica and Samuel exchange a few insults and then Erica says he'll regret crossing her! Sam calmly walks out of the court room. Jack turns to Erica, who has finally realized that Sam is serious, and tells her to come home with him for the night! They arrive home and Jack shows her to the master suite. Both are uncomfortable in the room so Jack quickly leaves, saying he'll sleep in the guest room. He grabs a few things and tells Erica things will work out. Erica falls asleep and dreams that Jack is her judge and has sentenced her to jail. Sam comes to her rescue, swearing that he framed her to get her attention because he loves her! Jack tries to call order back to the court room but Sam kisses Erica! Jack wakes Erica the next morning with a handful of morning papers.
Erica is stunned when the reporters question her about the arrest. Sam says she is being arrested for insider trading! Jack follows, telling Erica to keep quiet. Trying to save the show, Kendall, Aidan and Zach hold off the reporters. Pam says they are off the air and everyone sighs in relief. Greenlee invites everyone to the after-party at conFusion and Babe offers to get them limos. Greens grabs Annie, who is focused on Ryan, and asks her to make sure Amanda and the girls talk up the fashion show and not Erica's arrest. Ryan makes his way to Kendall but Zach intercepts him and tells him to go to conFusion! Zach tells Ryan that Kendall doesn't need him - Annie does. Then he goes over to Kendall who is nearly hyperventilating. He tells her things will be okay. JR distracts Ava with news that a "good looking rich dude" is looking for her and then grabs Babe to talk about their poker bet. Annie sees a few stragglers and offers to take them to the party. Greenlee corners Aidan and tells him they have to find a way to de-stress Kendall; he says he may have added to the problem by asking her about the pregnancy. Greens is stunned that he asked about it. Kendall comes over to tell Greenlee they have to get the fashion show squared away and then says she'll talk about everything else later. She and Greenlee grab the remaining stragglers and head them toward conFusion. Zach is watching Ryan very closely; Ryan is watching Kendall, hoping for an opening to talk to her and Annie is watching them all.
